Terms of Service

1. Acceptance of Terms

By accessing or using the BidMaster platform, website, or mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. We may modify these Terms at any time; your continued use constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By registering, you represent and warrant that you are legally capable of entering into binding contracts. BidMaster reserves the right to verify your identity and request additional documentation.

3. Bidding & Auctions

• All bids are binding and may not be retracted.
• The highest bidder at the close of the auction wins the lot, subject to any reserve price.
• BidMaster acts as an intermediary; the contract of sale is directly between buyer and seller.
• We reserve the right to cancel, extend, or reopen bidding in case of errors or technical issues.

4. Buyer's Premium & Fees

A buyer's premium will be added to the final hammer price, as disclosed on each lot. All fees are non‑refundable. Sellers are subject to commission fees, detailed in separate consignment agreements.

5. Payment & Taxes

Winning bidders must remit payment within 48 hours via accepted methods (wire transfer, credit card, or cryptocurrency where indicated). You are solely responsible for any applicable sales, use, or VAT taxes. BidMaster may collect and remit taxes where required by law.

6. Shipping & Risk of Loss

Shipping arrangements and costs are the buyer's responsibility. We may recommend carriers, but title and risk of loss pass to you upon our delivery to the carrier. Insurance is strongly recommended.

7. Intellectual Property

All content on the Service – including images, descriptions, logos, and software – is owned by BidMaster or its licensors and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Prohibited Conduct

• Shill bidding (placing bids to artificially inflate prices).
• Fraudulent misrepresentation of identity or provenance.
• Interfering with the Service or other users' accounts.
• Any activity that violates applicable laws or regulations.

9. Account Suspension & Termination

We may suspend or terminate your account at our discretion for violation of these Terms, without prior notice. You remain liable for any outstanding bids or fees.

10. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Rules. Arbitration shall take place in New York, NY. You waive the right to participate in class actions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BIDMASTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OF DESCRIPTIONS OR THE AUTHENTICITY OF ITEMS (SEE SEPARATE AUTHENTICATION POLICY).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDMASTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID US IN THE PRIOR 12 MONTHS.

13. Third‑Party Links

The Service may contain links to external websites. We are not responsible for their content or practices and your use is at your own risk.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced, constitute the entire agreement between you and BidMaster regarding the Service.
